In this case, a complaint has been filed with the NACC and is currently under investigation, and no indictment has been made yet, we cannot decide that they are guilty because the constitution does not specify that much. It is considered a matter that is under accusation, so it is assumed that they are innocent until there is a final judgment that they have committed an offense. However, the Council of State has advised that the details must be looked at on a case-by-case basis. When asked whether investigating the issue but not the individual would cause problems in the future, the Secretary-General of the Council of State said that the Council of State's duty is only to provide op inions to support the Prime Minister's discretion. The Constitutional Court has the power to make a decision. Furthermore, if a complaint is filed with the NACC and then generalized that there is a taint, it is not fair to the complainant because in some cases, the NACC does not provide any evidence.
